These Terms of Service govern your use of Takara. By downloading, installing, or using the Takara mobile application ("App") or visiting takara.cards ("Website"), you agree to be bound by these Terms of Service ("Terms"). Takara is operated by World Seed, LLC. If you do not agree, do not use the App or Website.
1. Acceptance of Terms
By downloading, installing, or using the Takara mobile application ("App") or visiting takara.cards ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Website. "Takara," "we," "us," and "our" refer to the operators of the Takara App and Website (operated by World Seed, LLC). "You" and "your" refer to you, the user.
2. Description of Service
Takara is a trading card game (TCG) collection management app that allows you to:
- track and manage your card collection;
- scan cards using your device camera;
- browse card databases and set information;
- organize cards in custom digital binders;
- track set completion progress.
The App is provided for personal, non-commercial use. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.
3. User Accounts
To use certain features you may need to create an account using a supported authentication provider (Apple, Google, or phone number). You are responsible for maintaining the confidentiality of your account and for all activities under it. You agree to provide accurate, current, and complete information and to keep it updated. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Payments
Takara offers a free tier and a paid subscription ("Takara Pro") with premium features including binder view, advanced filters, and additional customization.
Billing
Subscriptions are billed through your Apple App Store or Google Play account. Prices are shown in-app before purchase. Payments are processed by the platform and subject to their terms and refund policies.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription via your device's account settings.
Free Trials
If a free trial is offered, it automatically converts to a paid subscription at the end of the trial unless cancelled beforehand. Any unused portion of a free trial is forfeited when you purchase a subscription.
Refunds
Refunds are handled by Apple or Google in accordance with their policies. We do not process refunds directly.
5. User Content and Data
You retain ownership of any data you enter (collection data, binder configurations, notes). You grant us a limited license to store, process, and sync your data as necessary to provide the service. We do not claim ownership of your collection data. You may export or delete your data at any time through the App.
6. Card Data and Images
Card names, images, and related information are the property of their respective owners (e.g., The Pokemon Company, Bandai Namco). Takara is not affiliated with, endorsed by, or sponsored by any trading card game publisher. Card data is provided for informational and personal collection-management purposes only; commercial use is strictly prohibited.
7. Acceptable Use
You agree not to:
- use the App for any unlawful purpose or in violation of applicable laws;
- reverse-engineer, decompile, or disassemble the App;
- scrape, mine, or extract data in an automated manner;
- interfere with or disrupt the App's servers or networks;
- create multiple accounts to circumvent subscription limits or restrictions;
- resell, redistribute, or sublicense access to the App or its features.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to those practices.
9. Intellectual Property
The App, including its design, code, graphics, and user interface, is the property of Takara and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
10. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the App will be uninterrupted, error-free, or free of harmful components, and we do not guarantee the accuracy or completeness of card data, pricing, or other content.
11. Limitation of Liability
To the maximum extent permitted by law, Takara and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill, resulting from:
- your use or inability to use the App;
- any unauthorized access to or use of our servers or personal information stored therein;
- any bugs, viruses, or errors;
- any content or conduct of any third party on the App.
12. Termination
We may terminate or suspend your access at any time, without notice or liability, for any reason, including breach of these Terms. Upon termination your right to use the App ceases immediately. You may terminate your account at any time by deleting it through the App. Termination does not entitle you to a refund of subscription fees already paid.
13. Changes to Terms
We may modify these Terms at any time. For material changes we will notify you through the App or other means. Continued use after changes are posted constitutes acceptance.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which World Seed, LLC operates, without regard to its conflict-of-law provisions.
